Read the Supreme Court ruling on Trump’s birthright citizenship order

The Supreme Court on Tuesday struck down President Donald Trump’s executive order that sought to end birthright citizenship.

The landmark decision addresses one of the country’s foundational constitutional principles. Birthright citizenship is guaranteed by the Fourteenth Amendment, which states that:“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Trump issued an executive order in January 2025 titled “Protecting the Meaning and Value of American Citizenship.” The order sought to deny automatic citizenship to children born in the United States to parents who were in the country illegally or on temporary visas. It is not the first time the Supreme Court has weighed in on birthright citizenship. In the 1898 case United States v. Wong Kim Ark, the justices held that a child born in the U.S. to Chinese parents was a citizen.
